That is true with legal shorts. Naked shorts didn’t do any borrowing so those who bought these shares from naked short sellers would be able to vote since no borrowing took place.

You are not able to vote the shares that you lend (while the shares are loaned out). The borrower (temporary owner) has the voting rights. This is because the short seller is considered the registered holder of the shares.
