I would also say the true-up suit is fairly clear, though not yet "proven".
The issue is really about integrity. If you cannot trust management then you have to doubt a lot of the facts you are basing decisions on. And those can effect the likely hood of approval.
All the following would not be concerns with open and honest management.
. The FDA hold. Longs spin this as no big deal. I think most likely it was a futility rec and the NWBO attempt to restart by switching the primary endpoint to OS (from PFS) failed because the FDA would not allow it.
. After the trial NWBO has gone to FDA for the standard "how to go forward" meeting and the FDA said they need to run another trial. And so NWBO says nothing.
. The OS between 232 and 99 sucked. No trend at all in favor of DC-L.
All of these (if not true) could be dispelled by an open and honest management.
