RMB, The appeals court can vacate the order to dismiss. It looks like that is what they are going to do. The case is then remanded back to the district court. The ruling to dismiss at the pleading phase didn't go over well with the panel. This case should go back to the district court. Discovery schedule should then be set. It will be as if the dismissal never happened. It's not official until the ruling is issued. I still think it's likely. If you want I can post a link to the arguments.
