It will be fascinating (to me at least) to see how the lower court judge handles this once it returns to his court. No judge enjoys being overturned. And they seem to really dislike being overturned twice in the same case. So I think he'll be careful to let the case play out once it's back in his hands. But the one Federal Circuit judge practically spelled out what Hikma will need to do to get the lawsuit tossed out when the rules aren't so favorable to Amarin. I wonder if that might signal to the trial judge not to feel bad if he wants to dismiss it a second time. But as you pointed out earlier today, it's a whole new ballgame now because Amarin's lawyers can get discovery and look at emails and other evidence in search of a smoking gun or two. Amarin's lawyers must be overjoyed.

Marjac, As tis plays out do you think the "fraud on the court" argument could be put into
play at some point by Amarin?

Marjac, Do you think Amarin should apply for injunction or let Hikma sell the drug and catch them later with treble damages?

Appreciate your input. Thanks

An injunction which formally stops that, could cripple generic Vascepa.
