I wouldn't be concerned with it. I have 2 attorneys in the family and spoke with another. All say MTD's are rarely granted. Must be an obviously frivolous case without any merit whatsoever and even then MTD may be denied. No chance this case won't move forward towards discovery. IMO.

I think it is almost a given that MTD will be denied . I am pretty sure lawyers on both sides are pretty smart and know this and so does market .
So I think MTD denial as I have said before will be non event from market cap or SP standpoint .
