They should say whether or not the RS affects the AS or not. If not, then yes there would be 130mm available shares. If you are talking about a penny stock, that is the most likely case.

Have satisfied NASDAQ 10 day requirement but has still gone forward with proposal to initiate a RS by proxy vote.
