Frankly, I don't care if the judge agrees with Nixon in the sense that Nixon simply wins the trademark graphic logo case. All by itself, the business of selling things under the "ILLEGAL BRANDS" trademark is minuscule. It's an unknown with virtually no reason for anyone to give it a second glance.
HOWEVER, Ilegal Mezcal has gone to the bother of giving it that second glance BECAUSE it sees value in the trademark. Ilegal Mezcal opposed the trademark because it wants it, or thinks it somehow impacts its business; OR it thinks that making a deal of some sort for it will improve its own business.
So, I don't care if Nixon/Illegal Brands IP wins; I want to see the negotiated deal that has taken over two years to settle.
I suspect -- or theorize -- that once Nixon became aware of Bacardi's interest in taking over, he backed out of the initial deal (=he didn't sign it) in hopes of getting an even bigger deal. Good for him if that works; but I hope that he didn't blow the deal, which in turn has lead to actually duking it out in trademark court. Nixon might win, but he likely -- or at least possibly -- won't get anything from Ilegal Mezcal. After all, Nixon's defense is that the Illegal Brands trademark does NOT infringe on any of Ilegal Mezcal's existing business. Ilegal Mezcal could then say "screw you" and walk away, and keep its current business going without the additional boost from the trademark, and just let Nixon twist in the wind and eventually fade away. Nixon will be left with his "Illegal Brands" trademarked graphic logo that no one cares about.
Or, setting aside the above theory, maybe the two-year deal is finally done -- with or without last-minute modifications -- and for some reason the time for the 'big reveal' just hasn't come due yet.
Articles like the one I just posted the link to, about the big future for mezcal, suggest that it's wise to make a good deal when the time is right (before the market wave gets BIG), but not get too greedy for an impossible deal.
Now that Ilegal Mezcal is owned by Bacardi, Illegal Brands (=Nixon) is outgunned, money-wise. Although Nixon may be doing OK, he cannot afford to stay in court forever.
