If the judge believes that Samsung received a fair review and consideration of the April/2006 IDCC/Nok settlement by the Tribunal in rendering the final arbitration award, then he is empowered to confirm same. IDCC has more than likely educated the judge regarding the settlement involving both 2 and 3g issues which hinders Sam's ability to make a MFL claim. Sam never licensed 3g IPR from IDCC and its attempt to inherit 3g licensing status from the Nok PLA was denied by the ICC in the final arbitration award. Unless the judge has seen something that we have not been able to review from the redacted filings, this motion is ready for a ruling.
