I don't know when this will be calendared after all the delays the defendants can cause, but when it is, I'd be willing to bet that before they go to court, they settle. I suspect this is a case that a jury could award a huge penalty on and while they could delay settlement with appeals, I think they'll not risk what the jury might award. It should still be a multi-billion dollar settlement, but I think they risk far more than that if a jury truly chooses to punish them, and I believe the evidence will show that they should.
