If I can read it and KNOW FOR FACT, NOT OPINION NOR SPECULATION, I will never make another comment about 75/25% to the end...
Again with many references to the 75/25% as the payout matrix, OMISSION of ANY CONDITIONS that MIGHT HAVE APPLIED would have had to as well be spelled out to obtain waivers that would be immune ANY and ALL legal challenges over it.
And as all here KNOW FOR FACT, there has never been any reference to the 75/25 applying only to things in the LT or that it was only applicable to WMIH stock issuance, or that in any way was it limited to it's recover for either PREFR'D or COMMON EQUITY, so in short imho it was not limited
And any findings or rulings in a BK follow and are applicable in that case even after the case is closed.
