As expected, IFX is making a motion to stay the trial pending the outcome of the FTC proceeding. Decision should give a sense for Payne's state of mind.
Rambus has made a motion asking for an immediate stay of the March 7, 2001 Court Order forfeiting their Attorney Client Privilege under the Crime Fraud exception as to certain topics. Looks like Micron and American Lawyer filed briefs on this motion as well. Hearing on December 11 will give another good read on Payne's attitude about the retrial.With the fraud verdict reversed by the CAFC, hard to see how this order can stand. Maybe NicdaGreek can give some insight.
