The advantages of an AG seem obvious. Especially given the current insurance/formulary system and the inability to stop payers from inducing infringement through tier differentials, generic preference policies and practices, generic auto switching, and other financially driven shenanigans. Currently the Skinny label means little to them because they have a work around. Fortunately the HN suit and AMRN negotiations have helped AMRN obtain some decent coverage and exclusivity with some large payer groups. Without a legal victory against HN or having exclusivity on formularies, the infringement will continue. An AG seems like the great equalizer to the skinny label infringement problem. Let’s do it before generics double their supply or it will be too late.
