Doing something through a 3rd party does not shift NWBO’s responsibility for changing their plans.
NWBO released TLD on May 10, 2022 [by way of a 3rd Party] and that constituted a change in their October 5, 2020 plan and NWBO management has to own the consequences both good and bad (mostly bad).
If the stock price had gone up 1000% on May10, 2022 I doubt anyone would say “Well, NWBO management gets no credit because a 3rd party released the TLD instead of the company doing it directly.”
No, NWBO would have gotten the credit for the good outcome and not being doctrinaire about rigidly following.
Well instead it was a foul up that they did not follow their plan so they get the blame just as they would have gotten the credit.
Using a loophole to the embargo does not deflect responsibility for their business decision.
