Counterparty revised their complaint just before the decision. They had plenty of time to include new facts. The notion that it only was up to that point in time is false. Those were the facts they had and the ONLY facts they had to make their bogus claims. The court went through for 80 pp and dismissed everything. They were given the opportunity to file again and update if they wanted to keep the claim alive as it was motion practice. THEY CHOSE not to do so because there was NO BASIS in law to make their claims, and their facts did not meet the burden.
