I am not guessing. It’s quite clear cut. The ECA policy was not in final issuance. I can entirely anticipate the kind of advice they likely got from counsel without “guessing”. I’ve been in a position to discuss and advise over years on evolving policies and the contours of it are quite obvious that they were most likely being careful, not careless. It would make sense regardless of the actual circumstances, to be careful in that situation, which is why I do not need to guess.
