so there is a "deal, an "agreement", and a "contract".

Do you really believe that Synergy is bound legally to purchase 975K units? No contingencies? Like say the first few purchases fail to sell, will they be forced to continue buying?

Could they have a contract to distribute, and an agreement to purchase?
