That's quite interesting. I wonder if it's possible that Alito himself is the leaker.
It seems a plausible scenario, in a way. Several commentators have remarked that by now--at least two and a half months after the Alito opinion was written--there normally would have been several new versions. But that doesn't seem to have happened. A Supreme Court watcher has specifically said no revised versions exist.
If true, what would it mean? That the bad-tempered Alito put up a fight? Said, perhaps, that it was the most important opinion he'd ever written, and he didn't want anyone messing with it, not even to remove the offensive references to Matthew Hale?
Feeling even more offended than usual, did he then leak the opinion, so there'd be no doubt about what he'd said, now or ever?
