I have worked with teams on labeling including promotional literature and the discussions and legal and regulatory reviews were exhaustive and sometimes circularly limiting. I developed new appreciation of language. While some companies will push the envelope at times, the tote bag is considered a piece of promotional literature with regulatory and legal implications as you pointed out.
