It is apparent to me that the generics challenge to the marine patents were a pure money grab in which they had no intention to ever get to court in the first place but to have Amarin settle. Then we had the unfortunate situation where we had a judge who’s opinion was that Vascepa is just “fish oil”. Then appeal after appeal where judges were covering each other’s as@@@, even when Marjac handed them a silver plater to right their previous wrongs. If the generics were really serious about launching they would have taken the steps to secure the materials needed well in advance. But imagine if they did have the material... They would be infringing on the reduce it patents even more than they already are!!! Because obviously with the percent of prescriptions generics account for, they have no regard for the reduce it patents. Someone needs to be held accountable whether it’s the insurers or generics companies. They should count their lucky stars that 1) our case was lost by a judge with no merit to rule on this kind of case 2) they didn’t operate like a normal company with plans to launch a product by obtaining materials needed FOR a launch we’ll in advance ...
