We all know what happened last time with Amarin getting Rule 36'd less than 24 hours after a train wreck of an oral argument. That does not mean that will happen here. A new appeal, with different issues, and a different Panel. Despite what happened in Amarin's appeal, if they truly wanted to Rule 36 this case, they could have done so today without scheduling oral argument, and without even giving a reason.
