They could still Rule 36 after oral argument like they did with Amarin, but I am encouraged by the haste with which they schedule oral argument.

Might we have drawn a favorable Panel, who gets it, sees that this is unjust, and realizes that the patent exclusively time clock and all of the ongoing and daily corresponding injustices continue unabated without judicial relief sooner rather than later? One can only hope.
