According to Fawesome (He is a lawyer)the case is dead and their chance for success with an appeal is unlikely to succeed also.

I thought this case was about Patent infringement.

I don't believe what Batten did would ever be allowed in a Civil or Criminal case.

If a plantiff states he has 10 credible witnesses on his behalf and the judge decides one of them is not credible, do you disallow the other 9??

HCMC had pages and pages of evidence that was thrown out on a lawyer technical error. Does not seem fair.

The case is over. Judge previously ruled that snd allowed for the motion to amend. Now that amendment has been denied. This case is closed. They can appeal and/or they can find another way to sue. $HCMC LONG

According to the PR it says “ Amend its Complaint in its patent infringement case against Phillip Morris has been denied. As a result, the Court has dismissed the case”.
