Agreed. I do not think the FDA had any objections in following their intended policies and I do not think they would now object. But the confusion created by the regulator is the problem, IMHO. It is still not fully settled and they need to get things set so everyone is comfortable proceeding. The reality is, getting to approval is usually still a many month prospect, even in the best circumstances, particularly with novel implementations.
