Jimmy Joe, I don't think there is anything simple about it.
Even if speed is not an issue, to have to double your servers would be an enourmous task to undertake. We have a number as far as capacity goes but I have heard nothing about the difference in speed. It could be anything from insignificant to critical for Google. If there is a big difference in speed I think Google is going to have to work somenthing out with NetList. I have no idea where the tipping point would be speed wise, but I don't think Google would want to play that game anyway.
This may all be posturing for Google as they know they are going to have to negotiate a settlement at some point. Whatever the final result is going forward it must include an enforcement provision(allowing inspections) because there is no way you can trust Google after this.
