Yes, and that is why the Exchange Act excludes Exchange listed stocks from the penny stock definition, no matter what the price. They not only have the continued listing standards to contend with, but also the direct Exchange oversight, while OTC traded stocks have neither one.

I don’t disagree, was just stating that per the Words of the SEC anything less then X Amount is grouped into the same Lingo and Called a Penny Stock.
