At the moment, KBLB has no legal protection for their intellectual property associated with the EU patent.
KBLB cannot file an infringement suit until a patent is awarded. They can threaten a suit, but until a patent is issued, no lawsuit can be filed. This is why I feel their PR was deceptive.
I could file a patent for a time machine based on a quantum flux capacitor and then pretend I had ‘patent protection’ for a time machine. But I couldn’t sue anyone else. Once the patent office denied my patent, I again would not be able to sue.
All KBLB can claim is ‘patent pending.
No patent, no lawsuit, no protection.
