In Law School asked a very similar question about judges being wrong, and the professor responded in her sassy New York accent, "I'm the mommy." In other words, Judges have total control of their courtroom, and wide discretion on how they rule.

There is a human factor with some judges, too, where their egos an personal beliefs come into play, despite their oath to be fair and not allow personal beliefs to interfere with blind justice. The check on that is appellate review. Hopefully the Federal Circuit Panel will finally see this case the way we see it.
