Not curing the SEC filing delinquencies is a Civil matter not criminal - UNLESS it can be proven that Carter deceived shareholders to obtain financial gain - which I believe he did but that would be very difficult to prove. Plus you would need the Justice Department to deploy resources to indict and prosecute Carter - and that isn't going to happen.
What is your strategy for Carter to be prosecuted for Criminal Fraud?
I know what I would try but I don't think it would be successful.
I have never seen a public company CEO prosecuted for Criminal Fraud because they failed to file any financial information. But there is always a first time.
I would contact the former federal prosecutor for the United States Attorney for the Southern District of New York - Preet Bharara who was famous for prosecuting white collar crimes.
