My last hope of a quick resolution is the possibility that a deal to be acquired is mostly done and waiting on a final rejection by the Supreme Court before it can be announced. Otherwise, the company will try to prove that the U.S. market will continue to be a quagmire for generics as scripts steadily improve once people go back to their doctors. That could take a year or two.

Salt Salt Salt. I met Lars last night and he said a BO or acquisition is happening as we speak. Granted...it was a guy at the buffet with a name badge that read “Lars”....so I took him for his word. He said big things happening behind the scenes...like AMRN gonna buy a pipeline and GIA but most promising...the company was thinking about merging plastic forks and spoons into something called a spork for the buffet customers!!!!!
Tell me that’s not a nonobvious thing to do!!!

Mr. Murphy, The sooner a BP acquires AMRN the more time they will have
to benefit from the exclusivity period thus the more money they would make.
My guess is that Mr. Mikhail is there to establish the right pricing
for Germany so that the pricing in other countries will work out and be
a solid base from which BP could negotiate pricing with additional
countries. Ideally, he is setting the price for Vazkepa in Germany
to make negotiations with other countries at prices to make it profitable,
especially for a BP that would do the detailing and distribution. The
main reason for a BP BO for Europe is that that they are in a much better
position to negotiate country by country as they have done it before
and have professional contacts. My guess is any drug launch in Europe
will be more successful if you have seasoned reps with already established
contacts detailing the drug to doctors. If BP knows how the drug will be
priced in Germany it will give them a much better handle of what sales
and profitability would be. Your post indicated that AMRN had no interest
in GIA in Europe. Maybe that would be less important if the US had not
been lost to Du. Now, Europe is critically important to AMRN as it is
the most lucrative jurisdiction with a long runway for exclusivity.
If BP takes it over they could do very well, if AMRN really does GIA
it will be another Du-saster!

James Murphy, nothing is over until we say it is. I am planning on filing the Appeal tomorrow. If a belated BO happens, that would be most welcome, and certainly makes the most sense. But nothing is guaranteed, and I will pursue any and all legal remedies in due course, unless events such as a BO ultimately transpire.
