Let's examine the EXACT WORDING of Fritz's claim that DBMM is a "Timely filer", shall we? Here it is:

"DOE, in an overwrought and misleading submission on this appeal, insists that the Law Judge’s findings and reasoning should be rejected in favor of DOE’s own skewed characterizations of the Company and its conduct. For example, it begins by referring to DBMM as a “chronically delinquent filer” when, in fact, the Company had timely filed for years prior to the circumstances that caused the delinquency....


That little tidbit is on Page 1 (The Preliminary Statement).

Now HERE is a link to a record that shows the EXACT OPPOSITE of ANY claim by ANYONE that says DBMM has an "Timely" financial filing record BEFORE the OIP was Instigated:

That link CLEARLY SHOWS that out of roughly 46 filings since 2004 and leading up to the OIP in 2015, DBMM filed NT-10Q's or NT-10K's (NT stands for "NOT TIMELY" by the way!) 28 times!! DBMM filed untimely reports in 28 out of 46 filings!!

Talk about a clear record of UNTIMELY FILING, eh? Over 50% of their filings during that time period WERE NOT TIMELY!!


If ANYONE has ANY link that shows DBMM having a "timely" filing record from before the time when their delinquencies started (just before the OIP was instigated)? Then I'd REALLY be interested in seeing it!!

Otherwise? It's CLEAR that DBMM has a deserved reputation as a chronically LATE filer.
