UND can only enforce exclusive rights on behalf of KBLB if they have a patent in every country where KBLB wants to sell their silks.
The rights granted by UND aren't taken away regardless if there are enforceable patents in any given country.
This worthless conversation could go on forever, but lets say someone is able to get what we have and goes into production. KBLB's exclusive rights aren't effected and there is nothing that can be done about it. The only remedy is getting a patent in every country. Not going to happen anytime soon.
Saying that exclusivity does not exist without patent enforcement is the long way around saying they need patents. No one is arguing that they don't need patents. There are no remedies for this predicament except worldwide patent rights. If that happens then you have a near perfect patent world. In the mean time, KBLB will make money with the IP, licenses, and products no one else has.....for now. When they do figure out how to copy what we've done, then the argument for gas stations on all four corners of the same intersection comes into play. Given that fact, there is no reason to continue with worrying about that eventuality today.
