Functionally, though, Fannie Mae and Freddie Mac are unable to raise private capital because of Treasury’s preferred shares. Fannie and Freddie shares hold little allure at present to investors, since the conditions of the conservatorship mean they don’t receive a dividend.

So in effect this has done nothing. The biggest hurdle now seems to be the liquidation preference.

If I understand the case presented in front of SCOTUS correctly, we are fighting to end the NWS. So even if we win, the 10% dividend and liquidation preference remains in place? Or is part of SCOTUS that they wipe the SPS as well
