I notice his orders granted ex parte, are all still in place... by granting order for trail, the defendants ability to appeal just got magnitudes harder

Wrong, lol. Here's what the judge denied "for good cause."

Upon consideration of the motion of defendants Pacific Banking Corp., Justin Costello and GRN Funds, LLC. for a supplemental award of their attorney’s fees and costs as a sanction for the plaintiffs’ improper conduct in obtaining a default and now seeking a default judgment when the Court clearly lacks jurisdiction and there has been no proper service on these defendants


As demonstrated in the defendants’ May 14, 2020 motion to dismiss for lack of subject-matter jurisdiction [ECF Doc. 27], the plaintiffs brought this action without advising the Court that they are Marijuana Related Businesses. They also took up this Court’s time and resources in obtaining a number of orders, including a temporary restraining order and a preliminary injunction, when they knew, and should have told the Court, that this was the case.
