Well, my thoughts and assumptions were that the company is submitting a supplement

which fall under different parameters of rules

Where the parameters are the words: Might, Could, Maybe. Now that TenKay has steered us back onto the righteous path, one can toss in the FDA doesn't regulate down to the "Might, Could, Maybe" level for supplements. Where supplements are considered as unregulated.
