It is interesting
We all saw JWR610's post of a reply from Jim. I asked him almost the same thing last week (a day after the comment period ended.) He respectfully said he could not comment because it might be considered material info. This week he did answer but included "to the best of our knowledge." I think what he is telling us is that IF someone requested a hearing, it would have been posted by now. It is no longer material info because anyone that follows the NDEE web site and keeps track of how long it takes to get stuff posted, can figure it out.
Your analysis of what currently is and is not posted, pretty much confirms all that. I think now it is simply a matter of how long it takes the NDEE to provide their summary of responses.
We certainly are all anxious but need to keep in mind:
A very competent lawyer told me anyone can sue anyone over anything at any time. But, the process is not cheap nor easy. Parties will not expend the energy nor money unless they think they have a fair chance of prevailing. If the NDEE summary is thorough, complete, and professional (which will take time,) the chances of any future legal delay go way down.
