I don't think so. How could any ultimate legal question ever be proven if you are right? There are always a whole lot of factual underpinnings that go into supporting the ultimate conclusion. You can't prove them all by a high standard like clear and convincing. If you were right, how many patent claims would be found obvious? Not many, yet they are found obvious all the time.
