JL, you're talking about fairness.

You're 100% correct, and literally no one involved in the appeal is going to care about that.

That's why I say this is a political decision. If we get judges who care mostly about cheap drugs for the masses, it's over. Fairness won't matter.

This is about world views, not about principles of fairness.

JL, I agree with your point here. Property rights should be upheld and scumbag patent trolls should be banished. Unfortunately, even in the courts and federal agencies, "Money and Power Talks and Bull Shit Walks". We'll get through this legal definition just like we got through the science.
