Shareholders may/do have a say of sorts if they file an Amicus Curiae with the court. One of the lawyers here could probably file a very good Amicus brief.
and some wishful thinking:
If the court would accept such a brief, they might be able to raise one issue not directly on the record, i.e. how important this case and patent protection is to the whole area of medical research into new drugs. And the damage Hatch-Waxman has done over the years such that so much of our drugs are generics made off shore, etc. but I'm way off the record, one can only hope.
