You always thought this was a win before Monday. Why should people believe you now?
Nobody has to believe in me / accept my view. I always post my opinion … take it or leave it.
What was changed (since Monday)? … We know the ruling nd it contains additional information (e.g. Kubayashi .. ApoB reduction was not known by the USPTO … was not front of the USPTO).
My analysis was - mainly - based on inducement and I noted several times: I do not have enough info to make a strong conclusion about obviousness (meanwhile I thought / my impression was: the patents are non-obviouss.)
Again: I will post my full analysis / conclusion later … it is my current impression.
