You're on a roll today with cogent analysis, Poste. They had a formal in-court pretrial settlement conference with the Magistrate Judge. Prior to that settlement conference, each party had to provide the Judge with a confidential settlement position paper setting forth their settlement position, and the basis for that settlement position.

So it is an indisputable fact that each had a settlement position, and was ordered to put that position in writing to the Judge who was using her valuable court time to foster a settlement. The burning questions are what was each side's position? What was the basis for each side's position? What was each side's reaction to the other's position? What other settlement discussions took place?

Right now we are in the dark without any concrete answers. That is on the company, not on those of us seeking transparency and accountability.
