Great find, I hope Amarin is aware of this precedent/avenue of appeal and petitions the patent office immediately.

Would the same apply to the District Court?

Cal, I just sent your find to Elisabeth at IR to be sure they were aware of this avenue of appeal. Great find on your part. Kudos.

Cal

Yes this is the case the Yahoo poster mentioned, however I am still not ready to state this applies to Amarin's case.

Knowles Electronics LLC v. Cirrus Logic, Inc.,

I am really tired but cannot sleep, so maybe I am finding this a hard read.
It seems to me (at this point) Knowles was denied the patent and challenged the patent office through the courts. In the end it was a challenge on the definition of the word "package" as it pertains to electronic components. The patent office corrected the company's interpretation and that's all I got right now. LOL I am trying to find a case where the patent office overturned the courts on "obviousness"

T will try harder after sleep, emotionally drained right now.

CalM@ That is a very interesting link - Thanks !

It absolutely has to be investigated - if there in a chance to 'go that way' - Much easier and better than appeal - if it could be reality :)
