Perhaps you misunderstood what I said, as online communications sometimes skew as compared to direct spoken communications. I was unaware of Mori before analyzing this specific case, as I never had any reason to look it up or be aware of it.
I dismissed Mori as an obstacle in this case for the same reasons Amarin's lawyers did on pages 15-16 of their post-trial Brief. Obviously (no pun intended), Judge Du disagreed.
