If these patents are in fact SEP's (Standard Essential Patents)(Cable Labs term Certified) the court will recognize the
importance of the patents as they are recognized & USED by the industry. I believe the court/jury would place great weight on that recognition to the point that the industry itself places great value/importance of the patents.
