Or they just came up with a new idea and amended the theory. I'm not understanding why they are still filing. I thought that was the reason for "deadlines." If you don't have your briefs filed by the deadline, consider it dead? I guess it doesn't apply literally, at least not in this case. All of their briefs on the 4 theories they agreed to were due at the end of discovery. They file a 5th at the end of expert discovery and now they're allowed to continue filing amendments? It's annoying to say the least.
