Zomby has said some things I found to be speculative many times here and they always seem to come true. So maybe i'm a sheep in a way but I tend to listen regardless how speculative it sounds.
Plus in this case he is more than likely very correct in that the Judge will side with the PTAB since as we all know the PTAB is the standard in patent litigation in the court system. However there are unique cases like VHC where the PTAB destroyed their patents and the courts went against that verdict by awarding VHC regardless of their zero support from the PTAB.
Not to mention - the 13 are trying to bring a new theory to the table way to late in the process and I don't think that shines good light on them in reference to the Judge. It's disrespectful to the court proceedings and it's system set in place for a reason.
