Whether the Commission decides to bring a case in federal court or within the SEC before an administrative law judge may depend upon various factors. Often, when the misconduct warrants it, the Commission will bring both proceedings.

In this case it is clear that the "misconduct" has NOT warranted any enforcement action for KK and GERS. It appears that some action relative to BTZO has occurred. In other words, the SEC apparently has made determinations based on information not available to any of us that are : 1) contrary to your representations and accusations and 2) allowing GERS to continue to be traded and suspending trading in BTZO.

GERS... But not criminal if you are broke and under severe Business stresses! I doubt very much if the SEC would use that term with Penny Stock Co's and Ceo's who have always paid attention to SEC rules and regulations in the past, but have undergone severe Business stresses and couldn't do as the SEC had asked of them for a period of time?

Yes notices were sent by the SEC, and responses most likely given as to why they did what they did? And believe me, GERS has much proof in the way of paperwork to justify their absent filings for the past 2+ years or so?
