The FDA will be guided by Congress with new laws. The intent of hemp legalization was not to allow the FDA to do an end-run around Congress.

There's an easy fix. It would lawful under the FD&C Act to introduce CBD with food added to the CBD. That's a labeling issue which is political and cosmetic.
