I don't think its stupidity so much as sloppiness and laziness. Or maybe it's intentional. Maybe they know they don't have a chance but they're going to exploit (and make a mockery of) our legal system to drag it out because they can. They implied in their brief that they will file a petition with the supreme court if they aren't heard at the court of appeals, so they know they can drag this out at least another year.
