AF is still an editorial writer, not a reporter. That kind of puts a bit of "opinion" into whatever he states.

I do agree that the plain English of what he wrote asserted a fact (at least some of which is probably not true), but I believe Courts look at context also.

That is why material in social media is almost always considered nothing more than opinions, IMO.
