To go after AF now, they’d have to go after his allegation of trial failure, and if so, they’d give him the ability to access the data through the process. If his assertions are wrong, he is temporarily protected by this process. His willingness to keep stating failure as matter of fact in no uncertain terms keeps this fresh. Upon unblinding, I’d imagine, if a successful clinical/medical phase iii trial, AF has done all he can to demonstrate what an irresponsible member of the press can do to damage a small company, and then, with a corporate first Supreme Court, they would be more than pleased to castrate the free press. A free but responsible press is a shield against fascism. By acting irresponsibly, and perhaps getting the press cowed in the future, through the Court and legislature, fascism might, unfortunately, flourish.
